A day of lost opportunities

An interesting case came forth today. Two lower courts had held against my client (yeah, thats gives you an idea straight away na). Case was a Bombay Rent Act matter where the premises was sought by the Landlord from the Tenant (my client) on the ground of illegal sub-letting under Section 13(1)(e) (i think) of the Act. Now the Lower Courts held that the tenancy was not illegal, but yet decreed against my client on the ground that the premises was required bonafide for the Landlord for his personal use (yup, thats Section 13(1)(g) of the Act).

So we filed a Writ Petition against the order of the lower court on the ground that since i was a legal sub-tenant, a decree against me on the ground of bonafide requirement could only be given after i was heard (principles of Natural Justice for you laymen).

 Now when two Courts have held against you, the High Court rarely sets aside such decrees and it takes a lot for a Judge to to that. He needs to be totally convinced that Justice was indeed denied. This Judge on hearing the case, understood the small legal point we were on straight away. His exact words, ” if the words of the statute are strictly construed, you are right”, and gave e HUGE smile. A relief of sorts.  

Then, he proceeded to ask the otherside for its say on our contentions. Of course, the otherside claimed something contrary thereto and sought time to produce papers to substantiate their submission. Matter is now placed on Tuesday and i’m so looking forward to it.

 If only we had those papers with us. The case could’ve been decided today itself.

You are one disgusting man with no ethics or morals even for a lawyer finding loop holes in the law and using them on a failed and currupt justice system is another weak thing you do, the sad part is you are proud of it its a shame to india with laws and lawyers like you, you should be ashamed . Remember one thing there are a few respected lawyers still out there that will never take up a case if they think its wrong and people like you will never get to their level you will just be another dime a dozen lawyer . Iam sad that i came across your blog . Please dont email me back ever explaining a job of a lawyer or crap like that or to prove a point where you are right and iam wrong. India is still a third world country because 80% of people like you trying to make a quick buck and one day Karma will catch up with you . I have lost out on enough opportunities in life living in this city just cause i wanted to do the right thing and would never screw someone over to get to the top . i will leave this blog but i will leave these words never to come back again

    What i dont get is, you say all the beautiful words without any regard to practicing them yourself, only to accuse others (me) of being a certain way…..what does that say about you?……something between you and God my friend. D-day will come for you as it will come for me!

    Remember, anyone out there can do a ‘cut and paste’ job’ like you have done……do you have the courage to come forth and venture an argument face to face? Its funny to see the courage you get when you stay anonymous. Do you have the same courage face to face?….or are you just another frustrated loser who blames anyone and everyone for his own failures?

    Would love to have a one on one with you to get to understand you better. Choice is yours whether you want it private or public. Anonymous insults in blogsphere are largely considered a sign of lunacy. lol.

    As far as your comments on the law are concerned, i suggest you either get a lawyer to explain what is written…..or do a degree in law yourself…..and then talk to me if you feel the same way.

    Well, trust me…none of us give a tiny rat’s arse

    God, are you for real? To think that your pompous enough that pensive lawyer would scram to offer explanations/justifications/clarifications to you is making me laugh my butt off.

    Everybody is here to make a quick buck…arnt you? At the end of the day, all that your answerable to is your own conscience…and not to some schmuck who hides behind the walls of anonymity and makes ‘STUPID’ silly comments in the name of morality.

    Why would u want a tete-a-tete with him, pensive lawyer? Do u have time to waste? I’d rather u invest your time in making a ‘quick-buck’.

    Oh Golly, here I am wasting my client’s time in making a quick-buck…

  4. Querida: Thank you sweetie. As far as being a waste of time is concerned……time spent in understanding another’s point of view is hardly be a waste……of course, in our world where time is money its completely understandable (considering WHAT i’m trying to understand in the first place…lol).
